These terms also govern your use of VisionLens, an iPhone app published by BEREST Software. VisionLens is a preliminary at-home vision screening tool intended for parents and legal guardians who want to run awareness checks for their children. By installing, opening, or using VisionLens, you confirm that you have read these terms, the separate in-app disclaimers, and our privacy policy, and that you agree to them on behalf of yourself and any child whose vision you choose to screen.
VisionLens is a consumer wellness and awareness product. It is not a medical device and has not been evaluated or cleared as such by any regulatory authority (including FDA, CE, MDR, TİTCK). It is not intended to diagnose, cure, treat, mitigate, or prevent any disease or condition, including but not limited to amblyopia, strabismus, refractive errors, or any other eye or neurological disorder. Result bands produced by the app (for example "looks typical", "recheck", or "evaluate") are heuristic signals. They are not a clinical assessment and must never be used as the sole basis for a medical decision. If you have any concern about a child's eyes or vision, you agree to consult a licensed pediatric optometrist or ophthalmologist promptly, regardless of any VisionLens result. BEREST Software disclaims liability for decisions made in reliance on app output and strongly encourages continued, regular professional eye examinations for every child.
VisionLens is designed for use by adults aged 18 or older who are the parent or legal guardian of the child being screened, or who have the parent or guardian's explicit consent to run a screening on that child's behalf. The app is not directed to, and must not be used directly by, children. By using VisionLens you represent that: • You are at least 18 years old; • You are the parent or legal guardian of the child whose profile you create, or you have obtained consent from such parent or guardian; • You will supervise every scan session and maintain a safe environment for the child (adequate lighting, stable device, appropriate distance, no pressure or distress). You may stop a screening at any time. If a child is uncomfortable, tired, or unwilling, you agree not to continue.
VisionLens offers auto-renewing subscriptions and, where available, a one-time lifetime purchase. All purchases are processed by Apple through the App Store and StoreKit. By starting a paid plan you acknowledge: • Auto-renewing subscriptions renew automatically at the end of each billing period at the then-current price unless you cancel at least 24 hours before the end of the current period; • Any free trial automatically converts to a paid subscription unless cancelled before it ends; • Payment is charged to your Apple ID account at confirmation of purchase; • You can manage and cancel subscriptions from iOS Settings > [your name] > Subscriptions; • Refund requests are handled by Apple under its App Store policies; BEREST Software cannot issue App Store refunds directly. StoreKit transaction identifiers, entitlement state, and receipt validation are performed locally against Apple's StoreKit framework.
You agree to use VisionLens only for its intended purpose — lightweight, at-home wellness screening for a child in your care. In particular you agree not to: • Use the app as a substitute for professional medical examination, diagnosis, or treatment; • Present VisionLens results to third parties as a medical diagnosis or clinical finding; • Run scans under unsafe conditions (for example while driving, in very low light, at dangerously close distance, or in a manner that could distress the child); • Attempt to reverse engineer, decompile, scrape, or tamper with the app or its on-device models; • Use the app to screen a person who has not consented, or a minor whose parent or guardian has not consented.
To the maximum extent permitted by applicable law, BEREST Software, its directors, employees, and partners shall not be liable for any indirect, incidental, special, consequential, or exemplary damages, including but not limited to damages for missed or delayed diagnosis, loss of profits, goodwill, or data, arising out of or in connection with your use of, or inability to use, VisionLens or any result produced by it. Where liability cannot be excluded under applicable law (for example under consumer protection legislation), BEREST Software's aggregate liability is limited to the amount you have actually paid for the VisionLens subscription or lifetime purchase in the twelve (12) months preceding the event giving rise to the claim.
These terms of service may be changed without prior notice. Changes take effect as soon as they are published on the site and, for VisionLens, when a new app version is published to the App Store. Continued use of VisionLens after such changes constitutes acceptance of the updated terms.
